These Terms of Service (“Terms”) govern your use of this website (the “Site”) and your requests for quotes and rentals from Prime Tent & Furniture Rental (“Prime Tent,” “we,” “us,” or “our”). By using the Site or requesting a quote, you agree to these Terms. If you do not agree, please do not use the Site.
Your Rental Agreement
Each rental order is also governed by the quote, invoice, and rental agreement provided for that order. If anything in these Terms conflicts with your signed rental agreement, the rental agreement controls.
Using the Site
You agree to use the Site only for lawful purposes, to provide accurate and complete information, and to keep any account credentials confidential. You may not interfere with the Site’s operation, attempt to gain unauthorized access to any part of it, or use automated tools to copy its content.
Quotes, Pricing & Availability
Adding items to a quote online is a request, not a confirmed reservation. Your order is confirmed only after we verify availability and receive your signed agreement and deposit. Prices, availability, photos, and descriptions may change without notice, and we reserve the right to correct errors. Delivery, installation, labor, permit-related items, and taxes may be added to your quote.
Deposits & Payment
A non-refundable deposit of 50% of your order total is required to reserve your rentals. The remaining balance is due according to the schedule on your invoice or rental agreement. We accept major credit and debit cards as well as bank transfers.
Changes & Cancellations
Changes to your order depend on availability and may affect pricing. The 50% deposit is non-refundable. If you cancel more than 7 days before your event date, the deposit is the only amount owed. If you cancel within 7 days of your event date, the remaining balance is due and no refund will be issued, as described in your rental agreement.
Delivery, Installation & Site Access
You are responsible for providing safe, clear, and accessible delivery and installation areas and for telling us in advance about gates, parking limits, stairs, elevators, slopes, surfaces, and community or venue rules. Delivery windows are estimates and may shift because of traffic, weather, or other conditions beyond our control.
Before tents are staked, underground utilities must be located. Florida’s Sunshine 811 service marks public utility lines, but it does not mark privately owned lines. You are responsible for identifying and marking private underground lines such as irrigation, septic systems, pool plumbing, landscape lighting, and private electrical or gas lines. Where staking is not possible, tents may require ballast, which can affect pricing.
Permits & Approvals
Unless we agree otherwise in writing, you are responsible for obtaining any permits, inspections, and approvals required for your event, including approvals from property owners, venues, homeowners’ or condominium associations, and local governments. We are happy to provide guidance and tent documentation to support your application.
Care of Rental Items
You are responsible for rental items from delivery until pickup. Please do not move, alter, or disassemble tents; do not hang or attach items to tent structures without our approval; and do not use open flames, grills, or heaters under or near a tent unless we have approved the equipment and placement. Items must be kept secure and protected from theft and misuse. You will be charged for loss, theft, damage beyond normal wear, and excessive cleaning.
Weather & Safety
Tents are temporary structures and are not a safe shelter during lightning, high winds, or severe storms. Monitor the forecast, and move guests to a permanent building if severe weather threatens. We may delay, modify, or decline an installation, or remove equipment, if we believe conditions are unsafe, including during tropical storm or hurricane watches and warnings. Weather-related changes are handled according to your rental agreement.
Beach & Coastal Events
Events on or near the beach must follow local rules, including sea turtle protection ordinances that apply from May 1 through October 31 and regulate lighting and items left on the beach. Unless otherwise agreed in writing, you are responsible for obtaining any required beach or public property permits.
Intellectual Property
The Site and its content, including text, photos, graphics, and logos, belong to Prime Tent or our licensors and are protected by law. You may not copy, reproduce, or use Site content for commercial purposes without our written permission.
Third-Party Services & Links
The Site may include links to or features from third parties, such as maps, social media, and payment services. We are not responsible for third-party content, products, or practices.
Disclaimers
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, Prime Tent will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services. Our total liability for any claim related to a rental order will not exceed the amount you paid for that order.
Indemnification
You agree to indemnify and hold harmless Prime Tent and its owners, employees, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or rental items, your violation of these Terms or applicable law, or activities at your event, except to the extent caused by our negligence or willful misconduct.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be resolved in the state or federal courts located in Sarasota County, Florida.
Changes to These Terms
We may update these Terms from time to time by posting a new version on this page and revising the “Last updated” date. Your continued use of the Site after an update means you accept the revised Terms.
